Artwork City Terms and Conditions
Effective Date: 01 October 2025
1. Overview
This platform is operated by Artwork City Limited (“ArtworkCity”). “We”, “us”, and “our” refer to ArtworkCity. By visiting or using our website, you agree to be bound by these Terms & Conditions (“Terms”). ArtworkCity may amend these Terms at any time at our discretion; updated Terms apply from the date of publication.
2. Definitions
Artist - A person who created an Original Artwork and has the legal right to sell it, and who has uploaded the Artwork for sale via the ArtworkCity website.
Artwork - An original work offered for sale on the ArtworkCity platform. This includes: - Live Artwork: physical, original works (e.g., paintings, drawings, mixed media) shipped directly from the Artist; and - Digital Artwork (Physical Print): artworks created digitally that are supplied to the Client only as a physical product (e.g., canvas print or printed-and-framed work). Purely digital file downloads are not sold on ArtworkCity.
Client - A person who purchases Artwork via ArtworkCity.
Content - Any data posted on the platform, including images, listings, text, profiles, audio, and links.
Member - Any person with an ArtworkCity account, whether Artist or Client.
Platform - The ArtworkCity website, marketplace services, and Wall Viewer.
Wall Viewer - A visualisation feature allowing Clients to preview Artworks at actual size on their walls and optionally hear Artist voice recordings.
Words which refer to the singular include the plural and vice versa; and words importing one gender include the other genders.
3. Marketplace Function
ArtworkCity provides a marketplace for Artists to connect with Clients and transact. ArtworkCity is not a party to the sale contract between Artist and Client and is not liable for disputes between them.
4. Wall Viewer
The Wall Viewer provides a real-time preview with a ±3 cm margin of error. Accuracy depends on measurements provided by Users. ArtworkCity is not liable for loss arising from inaccurate measurements. Artists may add voice recordings; Clients may share designs on social media.
5. Artists
5.1. Signing Up
Register via our website. After verification, you will gain access to your Artist dashboard. Connect your payout method (e.g., Stripe) and publish your shipping and refund/returns policies. Membership approval is at ArtworkCity's discretion.
5.2. Information Required from Artists
Artists agree to provide: - Full name - Age - Gender - Ethnicity - Contact number - Email address - Physical address (for art pick-ups) - Artwork details (name, dimensions, medium, and high-quality photos)
Optional (recommended): - Artist profile/biography - Art philosophy or work insights (including audio) - Personal photo
Note: The demographic fields (age, gender, ethnicity) are collected for community insights and reporting and are handled in accordance with our Privacy Policy and applicable law.
5.3. Uploading Content
- Allowed: Live Artworks and Digital Artworks only when delivered as a physical product (e.g., canvas prints or printed-and-framed works). Purely digital file downloads are not permitted.
- Prohibited: AI-generated artworks are strictly prohibited. We value authentic creativity from real artists and are committed to showcasing genuine artistic expression.
- Live Artworks listed must physically exist and be available for sale. If sold elsewhere, the Artist must promptly remove the listing.
- If you require print fulfilment for eligible Digital Artworks or photographs, you may use your own vendor or our approved print partners, provided quality standards are met.
5.4. Prohibited Content
ArtworkCity does not accept obscene, pornographic, defamatory, racist, or unlawful content. We may remove content and suspend accounts at our discretion.
5.5. Marketing Licence (Artist Content)
Artists grant ArtworkCity a non-exclusive, transferable, royalty-free licence to use, display, modify and distribute their Content for the purposes of marketing and promoting the Artist, their Artworks, and the Platform (including on our website, email, social media, and ads). This licence does not transfer ownership and does not authorise resale or licensing of the Artwork itself. It remains in effect only for as long as reasonably necessary to carry out the marketing activities described above.
Marketing Material Retention
If an Artist removes an Artwork or closes their account, any marketing material already created, scheduled, or published by ArtworkCity may continue to be displayed, reposted, or remain available as part of past campaigns, platform content, or historical posts. This includes social media posts, emails, advertisements, and website features created while the Artwork was active.
ArtworkCity is not required to remove or retract historical marketing material but will not create new promotional content for removed Artworks.
The licence remains active for as long as reasonably necessary to carry out the marketing activities
6. Transactions and Fees
6.1. Commission Structure
Free (Non-Subscribed) Artists- Commission: 40% (inclusive of GST)
- GST Component: 15% GST is applied within the 40% commission.
Subscribed Artists (NZD $20/month)- Commission: 30% (inclusive of GST)
- How it works:
- At checkout, the standard 40% commission is temporarily deducted.
- At the end of each month, ArtworkCity transfers 10% cashback to subscribed artists (representing the difference between 40% and the subscribed rate of 30%).
- The cashback amount is minus applicable bank fees (e.g., Stripe or Afterpay processing fees).
- This results in an effective commission of 30% for subscribed artists.
6.2. Payment Processing Fees
Third-party payment processing fees (e.g., Stripe, Afterpay) apply in addition to the commission above. These fees are charged at the payment provider's current rates and may vary by card type, currency, and payment method. Please refer to the payment provider's published pricing for full details.
7. Shipping
Artists must publish and adhere to their own warranty and returns policy. Artists are responsible for shipping or arranging pick-up and for ensuring the Artwork arrives undamaged unless otherwise agreed with the Client.
8. Ownership and IP
Artists warrant they own or control all rights necessary to list and sell the Artwork and to license Content to ArtworkCity under these Terms. ArtworkCity is not liable for any infringement by an Artist or User.
9. Clients
9.1. Payment
Clients may pay using standard debit and credit cards. Payments are processed by Stripe.Afterpay is also available at checkout (where offered).
9.2. Delivery & Display
Artists select the courier and should include shipping costs in pricing. Colours and appearance may vary between on‑screen previews and the physical Artwork.
9.3. Billing Accuracy
ArtworkCity may refuse, cancel, or limit orders at our discretion. Clients must maintain accurate and current billing details.
10. General Terms
Users are responsible for their use of the Platform. To the maximum extent permitted by law, ArtworkCity is not liable for direct or indirect loss arising from use of the Platform, Artwork quality, accuracy, legality, or expectations. We may limit activities, issue warnings, or terminate memberships at our discretion.
11. Artist Subscription Terms (Additional)
11.1. Subscription Fee
NZD $20 per month.
11.2. Term & Renewal
Minimum commitment of three (3) months. After the initial term, the subscription renews month-to-month unless cancelled via email.
11.3. Payment & Activation
Upon accepting these terms (e.g., by ticking the subscription box), you will receive a secure payment link. Benefits activate once payment is confirmed.
11.4. Welcome Email
Subscribers receive a welcome email with access codes and instructions for the Artist Perks Program and guidelines to maximise benefits.
11.5. Cancellation
Email info@artworkcity.com to cancel. Cancellations requested within the first 3 months take effect after the lock‑in period. No partial refunds for unused time.
11.6. Subscriber Obligations
Keep listings current; respond to enquiries promptly; present Artwork truthfully; do not share partner discount codes privately or publicly (breaches may result in suspension or removal).
11.7. Changes to Terms
We may modify subscription terms at any time via email or website notice. Continued use after changes implies acceptance.
12. Subscription Process (How it works)
- Accept these Terms in your Artist dashboard.
- Receive payment link (Stripe) by email and complete payment.
- Activate benefits once payment is confirmed; your works are eligible for platform marketing.
- Access Perks using codes and instructions in your welcome email.
- Cancel after 3 months by emailing info@artworkcity.com (effective at end of current billing cycle).
